2015 Revised Underground Storage Tank Regulations

As many of you are aware, The U.S. Environmental Protection Agency (EPA) on June 22 issued final underground storage tank system testing and inspection regulations, marking the first significant revision to the regulations since they were issued in 1988 (notwithstanding the 1998 upgrade regulations).   In issuing the rule, EPA said the revised requirements include: adding secondary containment requirements for new and replaced tanks and piping; adding operator training requirements (currently in widespread implementation based on the 2005 Energy Act requirements and state implementation); adding periodic operation and maintenance requirements for UST systems; removing past deferrals for emergency generator tanks, airport hydrant systems, and field-constructed tanks; adding new release prevention and detection technologies; updating codes of practice; and updating state program approval requirements to incorporate these new changes.

MassDEP Issues New Underground Storage Tank Rules: 310 CMR 80.00

On January 2, 2015, MassDEP adopted a new Underground Storage Tank Regulation (“UST”, 310 CMR
80.00) that addresses design/construction/installation, registration, operation, maintenance and inspection of
UST systems used to store petroleum fuels and hazardous substances. These new rules have been
developed to implement M.G.L. c 21O, which was established by Section 7 of Chapter 4 of the Acts of 2009.
This law also transferred regulation of most aspects of the Commonwealth’s UST Program from the
Department of Fire Services (DFS) to MassDEP. The new regulation maintains the basic requirements
established by DFS’s regulation (527 CMR 9.00, which was rescinded on January 1, 2015) and by the U.S.
Environmental Protection Agency. MassDEP has also updated and streamlined requirements designed to
protect groundwater from UST system leaks.

On April 1, 2014, Senate Bill 373 was signed into law in West Virginia.  This bill became effective on June 6, 2014 and contains the Aboveground Storage Tank Act.  This act requires that all aboveground storage tanks (ASTs) in WV, must be registered by October 1, 2014

Rhode Island Single-Walled UST systems Removal Deadline

Owners or of a single-walled UST system in Rhode Island, should be aware that a deadline for permanent closure of these systems may apply to their facility, depending on date of install.

EPA Strengthening 1988 Regulations

Are you aware that the first time since federal regulations regarding underground storage tanks (USTs) were first promulgated in 1988, the United States Environmental Protection Agency (EPA) is proposing significant changes and additions to these regulations?  The proposed rulemaking includes new requirements for USTs primarily focusing on proper operation and maintenance, training, additional release detection requirements and testing of secondary systems and spill prevention.

Northeastern US States move forward with Phase-out of Stage II Vapor Recovery

If your gasoline dispensing facility is subject to Stage II Vapor Recovery regulations, the remaining days for your Stage II vapor recovery system may be numbered.   As you may have read or heard, some states have already changed their regulations to eliminate the requirement for Stage II Vapor Recovery.
